We would like to inform you, as a job applicant with one of the following controllers, about the details of the processing of your personal data and the rights you have in this respect.

When processing your personal data, we always proceed in accordance with the applicable legislation governing the protection of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as "GDPR") and Act No.

These entities are the controllers of your personal data and process it jointly (hereinafter referred to as "Administrator"). The controllers are therefore joint controllers who have concluded a processing agreement between them in which they have defined their obligations and shares in the processing.

The controllers assure you that they do everything possible to ensure that your personal data is properly secured and does not fall into the hands of unauthorised persons.

Scope of processing - personal data

We process your personal data to the extent that you have provided it to us directly or we have obtained it in the context of our recruitment activities. This may primarily include the following categories of personal data:

  • identifying information (e.g. name, surname, maiden name, date of birth, nationality, signature);
  • address data (esp. your permanent address, contact address for working from home or address for delivering documents);
  • contact details (e.g. telephone number, e-mail address);
  • details of competences (e.g. title, educational qualifications, certificates, work experience, professional competence, approbation, licence to drive motor vehicles);
  • information related to the job you are applying for (e.g. employer, job title, type of work, place of work, start date, type of work, type of work, length, duration, willingness to change, probationary period, notice period);
  • financial data (in particular financial expectations) and details of potential benefits (in particular the intention to assign a company car);
  • details for obtaining a residence permit (e.g. identification of the accommodation provider, travel document number, nationality);
  • information on the progress of the procedure for issuing a residence permit (in particular, information on whether it was granted or refused); 
  • data on accommodation for foreigners (e.g. identification of the accommodation provider, name, surname, date of birth, date of beginning of accommodation, date of end of accommodation);
  • audio-visual data (e.g. footage taken by CCTV, photographs);
  • data needed to prove legal residence and employment of foreigners (e.g. type and validity of visa/residence, work permit);
  • the data necessary for the authentication of the person when creating a profile account and its subsequent use;
  • other information provided by the candidate during the selection process via CV or similar documents on web portals, by email, in person or with the help of an intermediary (e.g. previous employment, references, hobbies, student status, etc.).

Purposes of processing and legal titles

Personal data is processed in paper or electronic form within HCM systems on the basis of the following legal titles and for the following purposes:

  • Communicating with job seekers regarding up-to-date information on job openings with administrators - Consent;
  • Communication with job applicants on the specific position applied for, including the preparation and conduct of the relevant selection and recruitment process - Legitimate interest;
  • Selection of future employees, assessment of the suitability of the candidate for the position - Legitimate interest;
  • Provision of assistance for the purpose of obtaining the necessary permits to work in the Czech Republic and facilitating the management of certain aspects related to the stay of a foreigner in the Czech Republic - Legitimate interest;
  • Necessary acts towards the conclusion of the employment relationship or the conclusion of a future contract - Conclusion and performance of the contract;
  • Protecting the interests and rights of the controller, e.g. reporting, corporate governance, dispute resolution - Legitimate interest;
  • Protecting the employer's data and internal network (increasing the level of security including controls) - Legitimate interest;
  • Protection of property, life and health of persons in the premises of the administrator through the camera system (ensuring a high level of security of the administrator's property, protection of life and health of individuals moving in the monitored area, prevention, detection, proof and prosecution of criminal activities) - Legitimate interest.

We do not use automated decision-making (i.e. decision-making based solely on automated processing of your personal data) or profiling.

The fulfilment of the legal obligations of the administrator arises in particular from these regulations:

  • Act No. 262/2006 Coll., Labour Code;
  • Act No. 435/2004 Coll., on Employment.

Recipients of personal data

Your personal data may be transferred to other entities besides authorised employees of the controller. In particular, the recipients of personal data may be:

  • administrators of the information technology used;
  • external suppliers of recruitment services, security services, etc;
  • law enforcement authorities (courts, police authorities);
  • software providers (especially HCM);
  • other public authorities and control bodies in accordance with applicable legislation.

We do not normally transfer personal data to third countries or international organisations, but exceptionally personal data may be transferred to third countries or international organisations, provided that the recipients provide sufficient safeguards for the protection of personal data. Some personal data is shared with the Foxconn group companies listed above, which are joint controllers. This is because some services and systems are used jointly across these companies and the same resources are used (e.g. in terms of HR departments). However, beyond necessity and technical limitations, we do not share your data with these companies.

Preservation time

The personal data processed on the basis of the performance of the contract will be stored for the duration of the rights and obligations arising from the contractual relationship, or for the period of time stipulated by the relevant legal regulations.

Personal data processed on the basis of consent will be stored for the period for which you have given your consent or until its withdrawal.

Personal data processed on the basis of legitimate interest will be kept for as long as the legitimate interest lasts.

Personal data processed for the purpose of "Protection of the interests and rights of the controller" are stored for the period necessary to protect the rights of the controller, but no longer than 4 years from the fact that is decisive for the protection of these rights, or for a longer period if the documents are related to, for example, an accident, injury to health or other extraordinary event.

Personal data processed for the purpose of "Protection of property, life and health of persons on the premises of the administrator by means of a camera system" are stored due to the legitimate interests of the administrator and the fulfilment of contractual obligations for a maximum of 30 days from the date of acquisition; subsequently, the camera recordings will be deleted and replaced with new data.

Your rights

According to the GDPR, you are entitled to the following rights related to the protection of personal data, which you can exercise in accordance with the terms defined in the GDPR.

Right of access

You have the right to request confirmation from us as to whether or not your personal data is being processed. If processing is taking place, you have the right to access your personal data and other information related to the processing, such as the purposes of the processing, the recipients of the personal data, the retention period, the sources of the personal data, etc.

The first copy of the personal data processed will be provided to you free of charge. In the event of requests for further copies, the controller is entitled to charge a reasonable fee corresponding to the administrative costs incurred.

Right to repair

You have the right to request the correction of inaccurate personal data or the completion of incomplete personal data.

Right to erasure

You have the right to have your personal data erased, except where we are prevented from doing so by legal obligations or where other exceptions are met.

Right to restriction of processing

You have the right to restrict processing in the following cases:

if you contest the accuracy of the personal data; the processing of the personal data is then limited to the time necessary to verify the accuracy of the personal data;

the processing is unlawful and you refuse the erasure of your personal data and request instead that its use be restricted;

the personal data is no longer needed for the purposes of processing, but you require it for the establishment, exercise or defence of legal claims;

you object to the processing of personal data on the basis of legitimate interest; the processing of personal data is then restricted until it is verified that our legitimate grounds outweigh yours.

Right to object

The right to object to processing is linked to processing carried out primarily on the basis of legitimate interests, in the public interest or in the exercise of official authority.

Right to portability

In the case of automated processing of personal data based on consent or contract, you have the right to receive your personal data in a structured, commonly used and machine-readable format. If technically feasible, we will send the personal data in that format directly to another controller at your request.

Right to withdraw consent to the processing of personal data

If you have given your consent to us processing your personal data, you have the right to withdraw your consent at any time in a manner that is at least as simple as the manner in which you gave it (and at the same time allows you to be identified). You may withdraw your consent in respect of all or only some of your personal data or the purposes of the processing. However, withdrawal of consent will not affect processing carried out prior to the withdrawal of such consent.

Right to lodge a complaint

If you believe that the processing of your personal data is in violation of the law, you have the right to file a complaint with the supervisory authority - the Office for Personal Data Protection, located at Pplk. Sochor 727/27, 170 00 Prague 7 - Holešovice.

Method of exercising rights

You can exercise your data protection rights by submitting a request to the data controller. The request must always contain at least identification data (name, surname, date of birth or other identifiable data), address data and a specification of the rights claimed. In order to prevent unauthorised access to your personal data by third parties, the submission of a request always involves some form of identity verification.

Applications can also be made as follows:

  • In person at the Compliance Department;
  • By mail to the Compliance Department at the Administrator's address;
  • By email to GDPRInfo@emea.foxconn.com;
  • Data mailbox.

If the personal data controller has reasonable doubt about the identity of the applicant - the personal data subject, it is obliged to verify the identity of the applicant on the basis of a request for additional information (e.g. date of birth, place of residence, date and method of sending the request, etc.).

All actions related to the exercise of your rights are free of charge. Exceptions may be made where requests may be judged to be unfounded or unreasonable, in particular due to repeated submissions. In such a situation, we are entitled to charge a reasonable fee corresponding to the administrative costs incurred in carrying out the requested actions, or we may refuse to comply with your request.

Failure to provide personal data

In general, you have the right not to provide us with your personal data. However, in the case of the establishment of a contractual relationship, the exercise of related rights and the performance of obligations, the provision of personal data may be a contractual requirement or a requirement to be included in a contract; in some cases, it may also be a requirement under law. If you do not provide personal data, then you cannot expect to enter into a contract between you and the Controller, nor can you expect the Controller to perform the contract.
